Employment

The rights of employee and employer, on the basis of the law

The employment relationship is a set of reciprocal obligations regulated by the Labour Law. We advise employers on organising their contracts and internal rules, and employees on understanding their rights and options when a dispute arises or employment ends.

What this area covers

  • Employment contracts and internal regulations
  • Termination of employment and dismissal
  • End-of-service entitlements and wages
  • Leave, working hours and overtime
  • Agreements and settlements between employee and employer
  • Representation before the courts competent for labour disputes

How we may help

  1. For employers: preparing clear contracts and policies and reviewing termination decisions before they are taken.
  2. For employees: explaining likely rights and what is needed to prove them.
  3. Negotiating an amicable settlement of claims.
  4. Representing either side before the competent court if settlement fails.

Information and documents that may help

  • The employment contract and any annexes

Common questions

Can an employee waive their rights in an agreement with the employer?

The law contains provisions protecting employees’ rights against waivers that contradict it. The details depend on the agreement and the case, so any paper should be reviewed before it is signed.

What should I do if I receive a notice ending my employment?

Keep a copy of the notice, your contract and your payslips, and do not sign any acknowledgement or release before it has been reviewed. Your position can then be assessed and the options explained.
